1. Acceptance of Terms
By accessing or using Order Form ("the Service", "we", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
These Terms constitute a legally binding agreement between you ("User", "you", "your") and Order Form.
2. Description of Service
Order Form is a web-based application that allows you to:
- Create custom order forms for your business
- Collect customer orders through online forms
- Automatically store order data in Google Sheets
- Manage product catalogs, prices, and options
- Receive order notifications via email
- Optionally integrate PayPal for payment collection

4. Account Registration and Google Integration
3.1 Google Account Connection
To use the Service, you must connect your Google Account. By doing so, you:
- Authorize the Service to create a Google Sheet in your Google Drive
- Grant permission for the Service to add order data to this sheet
- Agree to our access to your email address for account identification
Important: The Service uses a restricted Google API scope (drive.file) which means we can ONLY access files that our application creates. We cannot see or access any other files in your Google Drive.
3.2 Account Security
You are responsible for:
- Maintaining the security of your Google Account
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Permitted Use
4.1 Acceptable Use
You may use the Service for legitimate business purposes, including but not limited to:
- Creating order forms for products or services
- Collecting customer information and orders
- Managing your business operations
4.2 Prohibited Activities
You agree NOT to:
- Use the Service for any illegal or unauthorized purpose
- Collect sensitive personal data (credit card numbers, social security numbers, etc.) through your forms
- Violate any laws in your jurisdiction
- Create forms that promote hate speech, violence, or discrimination
- Spam or send unsolicited communications to customers
- Attempt to gain unauthorized access to the Service or related systems
- Reverse engineer, decompile, or disassemble the Service
- Use the Service to compete with us or create a similar service
4.3 Fair Use Policy
Our Service is designed to empower small businesses and individual entrepreneurs.
While we do not impose strict initial limits on data storage or usage,
we operate on a principle of "fair use" to ensure a stable and reliable experience for all our users.
Intended Use: The Service is intended for creating and managing an order form for typical small business operations, not for building high-traffic, large-scale marketplaces or enterprise-level applications.
Examples of typical fair use:
- Up to 500 products in your catalog.
- Receiving up to 1,000 orders per month.
- Up to 100MB of storage for your product images.
Note: These are guidelines, not hard limits. The vast majority of our users operate well within these ranges. Images uploaded by your customers with their orders do not count towards your storage limit.
Examples of usage that may require discussion:
- An unusually high number of product images (e.g., thousands) that suggests usage beyond a typical small business catalog.
- A sudden and sustained volume of orders (e.g., thousands per day) that indicates automated or non-standard use.
- Using the form in a way that generates extreme server load, impacting other users.
If we identify an account that is consuming excessive resources in a way that negatively impacts the Service's performance, we promise the following process:

Proactive Communication: We will contact you personally via email to understand your needs and discuss your usage.

Exploring Solutions: We will work with you to find a better solution, which may include optimizing your setup or proposing a custom plan tailored to your high-volume needs.

Clear Timelines: You will receive at least 14 days advance notice before any restrictions are applied, giving us ample time to find a solution together.
Your Data is Safe: This policy is about resource management, not data deletion. We will never delete your forms, products, or customer data without your explicit consent as part of this process.
This policy helps us maintain affordable pricing and high-quality service for the small business community we are proud to serve.
5. Your Content and Responsibilities
5.1 Content You Create
You are solely responsible for:
- All content you add to your forms (product descriptions, images, prices)
- Accuracy of information in your forms
- Compliance with applicable laws and regulations
- Any contracts or agreements made with your customers through the forms
5.2 Product Images
When you upload product images:
- You confirm you have the right to use these images
- You grant us a license to store and display these images as part of the Service
- You are responsible for ensuring images don't violate any copyrights or trademarks
5.3 Customer Data
You are responsible for:
- Complying with data protection laws (GDPR, CCPA, etc.) in your jurisdiction
- Having a privacy policy for your customers
- Obtaining necessary consents from customers
- Securing customer data stored in your Google Sheet
6. Service Availability and Modifications
6.1 Service Availability
We strive to provide reliable service, but we do not guarantee:
- Uninterrupted or error-free operation
- That the Service will meet your specific requirements
- That all errors will be corrected immediately
6.2 Modifications to the Service
We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Update features and functionality
- Change pricing or introduce new fees (with notice to users)
We will make reasonable efforts to notify you of significant changes.
7. Limitation of Liability
Important Legal Notice:
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED.
7.1 No Warranties
We disclaim all warranties including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of any information
7.2 Limitation of Damages
To the maximum extent permitted by law, we shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Service interruptions or data loss
- Errors in order processing or data transmission
- Actions or omissions of third-party services (Google, PayPal, etc.)
7.3 Your Responsibility
You acknowledge that:
- You are responsible for maintaining backups of your data
- You should verify all orders and customer information
- You are responsible for fulfilling orders placed through your forms
- We are not a party to transactions between you and your customers
8. Third-Party Services
8.1 Google Services
The Service integrates with Google Drive and Google Sheets. Your use of Google services is subject to Google's Terms of Service and Privacy Policy.
8.2 Payment Processing
If you enable PayPal integration:
- Payment processing is handled entirely by PayPal
- You must comply with PayPal's Terms of Service
- We do not store or process payment card information
- We are not responsible for payment disputes or failures
8.3 Email Services
Order notifications are sent via FormSubmit.co. We are not responsible for email delivery failures.
9. Intellectual Property
9.1 Our Rights
The Service, including its design, code, and functionality, is owned by Order Form and protected by copyright and other intellectual property laws.
9.2 Your Rights
You retain all rights to:
- Content you create (product descriptions, images, etc.)
- Your customer data
- Your Google Sheet and its contents
10. Termination
10.1 Termination by You
You may stop using the Service at any time by:

We may suspend or terminate your access if:
- You violate these Terms of Service
- You use the Service for illegal purposes
- Your account remains inactive for an extended period
- Required by law or legal process
10.3 Effect of Termination
Upon termination:
- Your access to the Service will be revoked
- Your Google Sheet will remain in your Google Drive (you own it)
- We may delete your account data from our servers
- These Terms will continue to apply to any past use of the Service
11. Indemnification
You agree to indemnify and hold harmless Order Form and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of third parties
- Content you submit or transmit through the Service
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes may be submitted to the competent courts.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by:
- Updating the "Last Updated" date at the top of this page
- Sending an email notification (for major changes)
Your continued use of the Service after changes constitutes acceptance of the new Terms.
14. Miscellaneous
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Order Form.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
14.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14.4 Assignment
You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
